Dow, S&P 500 end at five-year highs on early earnings beats

NEW YORK (Reuters) - The Dow and S&P 500 closed at five-year highs on Friday as the market registered a third straight week of gains on a solid start to the quarterly earnings season.

Morgan Stanley was the latest Wall Street bank to report strong results. Its better-than-expected earnings followed similar report cards from Goldman Sachs and JP Morgan Chase earlier in the week.

Shares of Morgan Stanley shot up 7.9 percent to $22.38. It reported a fourth-quarter profit after a year-earlier loss, helped by higher revenue at the bank's institutional securities business.

But Friday's rise was held back by shares of Intel Corp , which slumped 6.3 percent to $21.25 a day after it forecast quarterly revenue below analysts' estimates and announced plans for increased capital spending amid slow demand for personal computers.

Another factor that has been weighing on the market before a three-day weekend is uncertainty about the federal debt limit and spending cuts that could hamper U.S. growth. U.S. markets will be closed on Monday for the Martin Luther King Jr. holiday.

There were signs on Friday that the question of raising the U.S. debt limit would be put off for a while. House Republican leaders said they would seek to pass a three-month extension of federal borrowing authority next week to buy time for the Democratic-controlled Senate to pass a budget that shrinks deficits.

"It could be a big positive for the markets if we come up with a plan of spending cuts that isn't too awfully hard on the economy," said Bryant Evans, investment adviser and portfolio manager at Cozad Asset Management, in Champaign, Illinois.

The Dow Jones industrial average was up 53.68 points, or 0.39 percent, at 13,649.70. The Standard & Poor's 500 Index was up 5.04 points, or 0.34 percent, at 1,485.98. The Nasdaq Composite Index was down 1.30 points, or 0.04 percent, at 3,134.71.

The Dow and S&P 500 ended at their highest levels since December 2007. For the week, the Dow ended up 1.2 percent, the S&P 500 ended up 0.9 percent and the Nasdaq ended up 0.3 percent.

The CBOE Volatility index, Wall Street's so-called fear gauge, fell 8.2 percent. The VIX usually moves inversely to the S&P 500 as it is used as a hedge against further market decline.

Also reporting stronger-than-expected earnings on Friday was General Electric , whose shares rose 3.5 percent to $22.04.

Overall, S&P 500 fourth-quarter earnings are forecast to have risen 2.5 percent, according to Thomson Reuters data. That estimate is above the 1.9 percent forecast from a week ago but well below the 9.9 percent fourth-quarter earnings forecast from October 1, the data showed.

Economic data from China also provided some support to the market, though the focus remained on U.S. corporate earnings. China's economy grew at a modestly faster-than-expected 7.9 percent in the fourth quarter, the latest sign the world's second-biggest economy was pulling out of a post-global financial crisis slowdown which saw it grow in 2012 at its weakest pace since 1999.

Despite the gains by Morgan Stanley, financial stocks sagged as Capital One Financial reported disappointing profit. Capital One slumped 7.5 percent to $56.99, while the KBW bank index <.bkx> slipped 0.3 percent.

Volume was roughly 6.6 billion shares traded on the New York Stock Exchange, the Nasdaq and the NYSE MKT, compared with the 2012 average daily closing volume of about 6.45 billion.

Advancers outpaced decliners on the NYSE by nearly 2 to 1 and on the Nasdaq by about 13 to 11.

Day two of the University of California Regents meeting at the UC San Francisco campus on Thursday, Jan. 17, commenced with a series of public comment speakers adamantly addressing issues within the UC medical system.

Individuals, including a doctor, medical specialists, nurses, and Kenya Wheeler, a cancer patient and MA student at UC Berkeley, shed light on the range of concerns that have arisen, including the lack of compliance of the UC Student Health Insurance Plan (UC SHIP) to Obamacare?s Affordable Care Act. The majority of speakers entreated that the Board of Regents include these issues in their dialogue to better the way the medical system functions.

The existence of coverage caps for UC SHIP that have severely cost some UC students like Wheeler, who find themselves in the most desperate medical situations, proved to be one of the main concerns.

?With all the tuition and fees we pay, I never imagined that UC?s insurance wouldn?t cover the care I needed,? said Wheeler. ?It?s really hard to recover from cancer while having to negotiate sub hospitals by myself to get the care I need without going into bankruptcy.? Building on this conversation, Charlie Eaton, Financial Secretary of UC Student-Workers Union-UAW explained that he and he students he represents are ?calling for UC insurance to meet Obamacare standards,? despite the loophole maintained by universities to hold on to such coverage caps.

?Most students don?t know about the caps until it?s too late,? said Eaton. ?The care that they might need night not be covered.?

Another grievance, a lack of resources and funding for UC medical facilities to function sufficiently, was a hinted focus of speeches by Randy Johnson, an MRI technologist at UCSF, and Judy McKeever, Registered Respiratory Care Practitioner 2 at the UCSF medical center. In response to the increasing number of inexperienced, temporary graduate students being placed into hospitals to care for patients, McKeever implored that patients would greatly benefit from the hiring of experienced, qualified staff.

?Doctors? orders are not being followed,? said McKeever. ?Errors are being made in patient care and people are being harmed.?

Concerns about the financial accountability of the regents were also expressed. Hank Gehman, a concerned Californian citizen, pointed to UC Berkeley?s new football stadium as what he believed to be a marker of UC?s failure to adequately handle spending.

?[UC] knew they didn?t have the money but violated their own policies and pushed the [Cal stadium] project through regardless,? said Gehman, suggesting that a state-wide electing of regents would improve the quality of the UC system?s decision making and therefore increasefinancial accountability. An underlying message of overall improvement of the UC?s functionality in these areas permeated the public comment forum.

?I believe [governance and finance problems] are tightly linked,?said Gehman. ?Constant scrutiny making the regents accountable would be a good next step.?

Kids at center stage in emotional gun debate

WASHINGTON (Reuters) - "Dear President Obama," began a letter from 8-year-old Grant Fritz, with the shaky printing -- missed words, spelling errors -- of someone just learning how to put thoughts down on paper.

"I think there should be some changes in the law with guns," Fritz said in the December 17 letter he sent to the president days after the Newtown school shootings.

Invited to the White House on Wednesday, Fritz and three other children in their Sunday best sat on stage as Obama read out parts of their letters to illustrate why he wants to tighten gun laws.

The children's' presence at Obama's announcement aimed to keep kids at the heart of the often emotional battle over gun control, which reignited with the murder of 20 first-graders in Newtown, Connecticut, last month.

The president's own young daughters were dragged into the fray on Tuesday when the National Rifle Association put out an ad accusing Obama of hypocrisy by giving the girls armed Secret Service protection.

That broke a long-held taboo against using a president's children in political attacks and outraged the White House, which described the ad as "repugnant."

A-GRADE VS FIRST GRADE

With the letter-writing children looking on, Obama announced wide-ranging plans for gun control, including bringing an assault weapon ban to Congress. He challenged Americans to ask their lawmakers to support his plan despite objections from groups who believe the measures will infringe on gun ownership rights.

"Ask them what's more important: doing whatever it takes to get a 'A' grade from the gun lobby that funds their campaigns, or giving parents some peace of mind when they drop their child off for first grade?" Obama said to applause from a crowd of interest groups, Democratic lawmakers and law enforcement officials who agree with his plan.

Anger and pain over the December 14 Newtown shooting has been a common topic in the stacks of letters from Americans that flood into the White House. Obama says he reads 10 letters a day from the public.

Julia Stokes, 11, wrote that she "may not (be) that into politics but my opinion is that it should be very hard for people to buy guns."

"I know that laws have to be passed by congress but I beg you to try very hard to make guns not allowed," wrote Julia, who dotted her 'i' with a heart.

Hinna Zeejah, 8, whose patent-leather Mary Jane shoes didn't reach the floor as she sat on the White House stage, wrote, "I feel terrible for the parents who lost their children."

In the front row of the event sat Chris and Lynn McDonald, whose 7-year-old daughter, Grace, was killed at Sandy Hook Elementary School in Newtown.

"I'm told she loved pink. She loved the beach. She dreamed of becoming a painter," Obama said. Her parents looked at each other and smiled as the president spoke of how one of Grace's paintings now hangs in his private study.

The horror of the Newtown school shooting made a significant difference in the debate over gun violence, said Annette Nance-Holt, who lost her only child, Blair, in a shooting on a city bus, when he was coming home from school in 2007.

"In Chicago, we've been waiting for a long time. I don't just represent Blair - that was my baby - but there are so many other babies in the city of Chicago that have been gunned down innocently," Nance-Holt told reporters, wearing a picture of her son on her lapel.

"Now we have a groundswell of movement. We have 20 babies, and people are looking at this totally different."

Obama was criticized by conservative pundits and bloggers as using children as political "props."

"I don't even know what to say about the White House publishing letters from children for political purposes. It's just so disgusting," tweeted Michelle Clouthier, a libertarian blogger.

In its ad, the NRA accused Obama of being "just another elitist hypocrite" for allowing armed Secret Service protection for his daughters but turning down the lobby group's proposal after the Newtown shooting to put armed guards in all schools.

That drew fire from White House spokesman Jay Carney.

"Most Americans agree that a president's children should not be used as pawns in a political fight. But to go so far as to make the safety of the president's children the subject of an attack ad is repugnant and cowardly," Carney said.

Government hires banks to hold GM stock sale

DETROIT --?The U.S. government is hiring JPMorgan Securities and Citigroup Global Markets to handle the sale of its remaining stake in General Motors.

The Treasury Department still holds 300 million shares of GM common stock that it got as part of a $49.5 billion bailout of the Detroit automaker.

GM bought back 200 million shares last month for $5.5 billion. The company says it won't buy back any more.

The banks will get one cent for every share they sell for a fee of up to $3 million.

The government says it will sell all the GM shares by early in 2014. Even with the sale taxpayers are likely to lose billions on the bailout.

The government now owns about 19 percent of GM.?
